Transactions can be broadcast with the min fee encoded in the payment id. The min fee per kb can be set as the min(0.001,weighted median by locked amounts). This could be a great way to trustlessly determine some of the constants. Also it would limit the strength of a spam attack because the locked coins are required to reduce the fee so they are not available for the attack.
