Should stylex.create() and stylex.createTheme() always be called at module scope?

Question on how rules should be enforced. Like, this is not a pattern found in the docs, but should it be expressly forbidden by the ESLint rule or be a compile error?

export function MyComponent() {
  // is this legal inside component scope?
  const styles = stylex.create({
    foo: {
      background: 'lime',
    }
  })
  
  return <div {...stylex.props(styles.foo)}>Hello world</div>
}

Which then begs the question, when is too much?

export function MyComponent({ someProp }) {
  // now this has a runtime?
  const styles = someProp ?
    stylex.create({
      foo: {
        background: 'blue',
      }
    }) :
    stylex.create({
      foo: {
        background: 'lime',
      }
    });
  
  return <div {...stylex.props(styles.foo)}>Hello world</div>;
}

Should either or both of these throw an error, rather than compiling? Or is this something that is the consumer’s responsibility to enforce in their own codebase?
